Featured in Netflix’ series “The Chair,” Pembroke University is back in the news.  This time, a Recognized Student Organization has participated in a program affiliated with “Karl’s Kids”, a national organization’s initiative of inviting children of community members with cancer to an uplifting weekend away from home in a college dorm during their Spring Break to give the parents a rest, where the RSO student members are the children’s hosts.  The program brought terrific PR to Pembroke, but unfortunately when one of the activities is a group balloon release from an exterior balcony of the three-story student union building, one of the children climbs over the railing with tragic results.  Today’s session features the mediation of the resulting litigation.

Objectives:
+Highlight issues involving the relationship between an educational institution and its Recognized Student Organizations, and the not-quite-independent status of the RSO’s.
+Review the essential interactions during the mediation of a high-stakes mediation of a complex civil litigation involving the institution, the RSO, the student leaders, the insurer and the external counsel.
+Demonstrate steps the institution’s risk management and general counsel offices can take to work together – and with their external partners – to achieve a reasonable outcome under difficult circumstances.
